Workmans Comp Settlements

  

Many people who are hurt at work know that they are entitled to workmans comp, also known as workers compensation. Often they want to know what are the workmans comp settlements for workers who have suffered similar injuries to the injuries that they suffered. Unfortunately, it is difficult to compare cases.

Workmans comp was created to help workers by making it easier for workers to recover for injuries suffered at work. Before workers compensation, employees and workers had to prove that their employer was, in some way, at fault for the employee or worker being injured. Often times, it was difficult to prove that the employer was at fault. To remedy the situation, states adopted workers compensation law that removed the proof requirement. In exchange for not requiring proof of the employers fault, states adopted formulas to determine the compensation owed to the employee worker and placed caps on the amount of compensation.

Since states have formulas for determining the compensation, you would think that the amount of compensation is "cut and dry". It is sort of "cut and dry", but it also isn't.

For example, most state workers compensation law set the amount that an employee worker would receive for the loss of a hand and for total disablility. Since the amount for losing a hand is set, you would think that that is the amount that the employee worker would receive if he or she lost the total use of his or her hand. However, a workers compensation lawyer would argue that the employee worker has suffered a partial total disability by not being able to use his or her hand and that the employee worker is entitled to more compensation.

Basically, when it is clear that an employee worker was injured at work, workers compensation lawyers are arguing over the amount of compensation.

Because every person is different and every case is different, it is difficult to compare workmans comp settlements and determine how much compensation you are entitled to. The best course of action is to talk with a workers compensation lawyer licensed in your state and ask him or her for an idea of what your compensation should be. The lawyer will not be able to tell you exactly what you should receive, but the lawyer should be able to give you an amount range or a "ball park figure".
