Workers Compensation Lawyer Fees There are two good things about workers compensation lawyers and their fees: First, most workers comp attorneys will talk with you initially free of charge. You do not pay anything for the first consultation. However, you need to realize that most of these lawyers will want to and try to sign you up right then and there, if you have the slightest workers comp case. Attorneys are people and they have different views and different ways of handling things. Some will give you good honest information and advice. Others, will possibly take advantage of you, if they can. The best thing to do is to talk with several workmen compensation lawyers and then decide whether or not to hire a lawyer and, if you decide to hire an attorney, which lawyer to hire. Second, workers compensation lawyer fees must be approved by the state's Workers Compensation Commission or Board. Most states limit the fee to either a forth (25%) or a third (33%) of the contested benefits that are paid directly to the injured worker. This basically means that worker comp attorney fees are contingency fees. If an attorney does not recover compensation for you, your attorney does not get paid. As always, make sure that you understand and have in writing any fee arrangement with a workers compensation attorney.
