It is inevitable that there are a lot of cases in which the employee and the employer disagree as to severity of the employee's injury and therefore disagree on how much compensation an injured employee is due. There are also times when an employer believes that an employee's injury is not work related. Someone has to resolve these types of disputes between employer and employee.

Since special workers compensation law applies to work related injuries and employees do not have follow the normal laws for personal injury to prove that their employer is at fault for the employees' injury, states have created a special commission or board to determine all issues concerning workers compensation.

In other words, if you are injured at work and your employer disputes your injury or the compensation to which you are entitled, you do not sue your employer in court. Rather, you file your claim with your state's workers compensation commission or a workers compensation board. The commission or board then resolves the dispute by determining if your injury is work related and the compensation to which you are entitled.
