How Does Workmans Compensation Work |

Workmans compensation is a blend of workers compensation law and workers compensation insurance. Before current workers comp laws, if an employee was hurt or injured at work, the employee had to prove that the employer was at fault in some way. Often, it was difficult to prove that the employer was at fault for the employee's injury and the employee did not receive any compensation for his injury. To correct the problem and provide compensation for work injuries, states adopted workers compensation law. Basically, states made it easier for workers to receive compensation, but placed caps or limits on the amount of compensation due an injured worker. While there are factors which affect whether or not an employee is entitled to compensation for an injury, an employee does not have to prove that he or she was injured because of something that his or her employer did or didn't do. Whether the employer was at fault or not doesn't make a difference. To protect workers from employers that were insolvent or who would not pay the workers comp benefits, states required that certain employers have workers compensation insurance. When a worker is hurt or suffers a work related injury, state workers compensation law tells what the worker is entitled to and then workers compensation insurance pays what is due. Workmans comp laws say that workers are entitled to medical treatment for injuries, but the employer chooses which doctor or hospital is to provide the treatment. The medical bills are paid by the workers compensation insurance. Workmans comp laws say that when an employee misses a certain amount of time from work due to his injury, the employee is entitled to be paid. Normally, it is reduced pay because workers compensation benefits are not taxable. The employer does not pay the employee. Instead, the employee is paid by the workers compensation insurance. Workmans comp laws say that an employee is entitled to be compensated for a disability or disfigurement. Again the amount of compensation is determined by state workers comp law, but it is the workers compensation insurance that pays the employee. The above is general information only.
