Do You Need A Workers Compensation Attorney?

You, yourself, must decide if you need a workers compensation attorney. If your work injury is minor and your employer arranges for you to see a doctor and treats you fairly, you may not need a lawyer. But if your work injury is significant or your employer "jerks" you around, you probably need a workers compensation lawyer.

There are certain times when you really should consult with a workers comp lawyer.

First, if you suffered a work related injury which may require medical treatment in the future. Generally, workers comp is responsible for paying for future medical treatment. However, this responsibility to pay for medical services can be transferred to the injured employee in a workmans compensation settlement. So, if you think that you may require future medical treatment, talk with a workers comp attorney before settling your case.

Second, if either your employer or it's workers compensation insurance carrier deny your claim, you need to talk with a workers comp lawyer. There may be a legitimate reason for the denial, but there may not be. It may be that your employer or it's workers compensation insurance carrier are just jerking you around. A lawyer should be able to tell which is the case.

Third, if your injury appears to be a permanent disability, talk with a workmans compensation attorney. A permanent disability means that it will affect you the rest of your life. You need professional guidance to make sure that you receive all of the benefits to which you are entitled.

As a side note, I believe that if you have a minor accident at work and your injury is minor, you may be OK to resolve your claim without an attorney. But if you have anything more than a minor injury and you miss any work, I tend to think that you should talk with a workers compensation lawyer. You, and you alone, must decide whether or not to talk to or hire a lawyer.
